These terms of use (“Terms”) are a binding agreement between you and Peak Consultancy WLL (“Peak”). By visiting Peak’s website, located at http://www.peakbahrain.net (the “Website”), you hereby confirm that you accept and will abide by the Terms. The Terms governs the relationship between Peak and any visitor the Website (the “User”). Peak does not permit those under 18 years of age to visit the Website, so if you are below this age then you must leave the Website. Peak’s privacy statement posted on the Website (“Privacy Statement”) is also applicable to the User. The Website and its original content features and functionality are and will remain the exclusive property of Peak and its licensors. The Website is protected by copyright, trademark, and other laws of all applicable jurisdictions. Peak agrees to implement industry standard methods to try and prevent computer viruses, worms, software bombs, or similar items from being introduced into the Website, but Peak shall not have any liability in this regard. The User may only access the Website for lawful purposes, and will take reasonable steps to ensure that no computer viruses, worms, software bombs, or similar items are introduced into the Website. The User will immediately notify Peak of any irregularities, defects or problems experienced in relation to the Website. No part of the contents of the Website may be copied or reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopying and recording, for any purpose without the express prior written consent of Peak. The Website may contain links to third-party web sites that are not owned or controlled by Peak. Peak assumes no responsibility for, the content, privacy statement, or practices of any such third party web sites, and Peak shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third-party web sites. Peak has the unfettered right to end or suspend the User’s access to the Website immediately, without prior notice or liability, for any reason whatsoever, including without limitation, in the event the User breaches the Terms. Peak is solely a business consulting firm, and neither it nor its officers, directors or shareholders are licensed to practice law in the Kingdom of Bahrain. Therefore, Peak will not be able to issue a formal legal opinion to the User in relation to the laws and regulations of the Kingdom of Bahrain, either by means of the Website or via any other method, and the User acknowledges this state of affairs. Peak shall not be liable for any alleged damages or losses of any kind incurred by the User in relation to the Website, unless Peak has committed fraud, gross negligence, or willful malfeasance. In any jurisdiction that does not allow Peak to exclude and/or avoid liabilities or warranties, Peak’s liability will be limited to the maximum extent allowed by applicable law. The Website is made available to the User with all faults and defects without warranty of any kind. Peak expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Website, including all implied warranties of merchantability, and fitness for a particular purpose to the maximum extent allowed by applicable law. The laws of the Kingdom of Bahrain, excluding its conflicts of law rules, shall govern and be applicable to the Terms. Any dispute arising in relation to the Website shall be resolved by the courts of the Kingdom of Bahrain, and the User hereby acknowledges that by accessing the Website such courts will have jurisdiction over the User. The User must leave and cease and desist from accessing the Website if it is: located in a country that is subject to a government embargo implemented by the Kingdom of Bahrain, or that has been designated by the Kingdom of Bahrain’s government as a “terrorist supporting” country; and/or (ii) named as a prohibited or restricted party on any list maintained by the government of the Kingdom of Bahrain. If any provision of the Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect. Peak’s failure to exercise a right or to require performance of an obligation under the Terms shall not effect its ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach. If any information that is designated as confidential or which by its nature is clearly confidential or which the receiving party knows or should reasonably know is confidential (collectively, “Confidential Information”) is obtained under the Terms, the User and Peak will treat this information as confidential. Subject to the Privacy Statement, neither the User nor Peak will, without the express prior written consent of the other, disclose Confidential Information to any third person or use the same except in compliance with the Terms.
The previous paragraph does not prohibit disclosure of the Confidential Information to:
(a) the receiving party’s auditors and professional advisors and any person having a statutory or regulatory right to request and receive that information; and
(b) any other person pursuant to a court order or any other regulatory body having appropriate authority, provided that the disclosing party has first been given a reasonable opportunity to contest such disclosure (unless the court, or other regulatory body or person having appropriate authority has ordered or instructed the receiving party not to disclose that such order or request has been made).

(b) any other person pursuant to a court order or any other regulatory body having appropriate authority, provided that the disclosing party has first been given a reasonable opportunity to contest such disclosure (unless the court, or other regulatory body or person having appropriate authority has ordered or instructed the receiving party not to disclose that such order or request has been made).
The User will indemnify and hold harmless Peak, its owners, officers, directors, employees, (collectively, “Indemnified Parties”) from and against all and any damages, losses, expenses and costs (including any reasonable legal fees and accountants’ fees) incurred by the Indemnified Parties which result from any breach of the Terms by the User.
The Terms and the Privacy Statement are the only terms and conditions applicable to the Website. The User acknowledges that it has not relied on, and shall have no remedy in respect of any statement of fact or opinion not recorded in the Terms (whether negligently or innocently made).
